IMPORTANT: The Council of Ministers adopted Decision 204 respecting Regulation (EU) 2020/426 of 19 March 2020

On 26 March the Council of Ministers adopted Decision 204 (attached below). This decision sets the Bulgarian legal framework for the export of sanitary equipment in accordance with the existing European regulation, in particular Regulation (EU) 2020/402 of 14 March 2020, as amended by Regulation (EU) 2020/426 of 19 March 2020 (attached below).

The Swiss Embassy in Bulgaria requested and achieved the implementation of this essential regulation by the competent Bulgarian authorities.

According to the Council of Ministers’ Decision 204 of 26 March 2020:

– Disinfectants or their derivatives, as well as the products Mentioned in Annex 1 of EU Regulation (EU) 2020/402, are prohibited for export and must be authorized in order to be exported;

– These prohibitions do not apply to the countries of the European Union, as well as to the countries and territories listed in Art. 1/3 of

Implementing Regulation (EU) 2020/402. According to Art. 1 (3): ‘Implementing Regulation (EU) 2020/402 is amended as follows: (1) In

Art. 1, the following paragraph 3 is added: ” 3. Exports to Norway, Iceland, Liechtenstein, SWITZERLAND, as well as to the overseas

countries and territories listed in Annex II to the Treaty and to the Faeroe Islands, Andorra, San Marino and the Vatican City State, are not

bound by the measures referred to in paragraphs 1 and 2. “‘;

As concerns Switzerland, the Council of Ministers’ Decision 204 of 26 March 2020 specifically authorizes the following:

– With regard to sanitary and medical products, Decision 204 authorizes exports to Switzerland without authorization for disinfectants or

derivatives thereof, as well as of the products referred to in Annex 1 to Regulation (EU) 2020/402.
